I’m 3 months pregnant. I was recently in a car accident which causes me back and neck pain. So i cant be on my feet …also the doctor ordered me to be rest since I’ve had a threatend abortion. I was served a summons and a letter of case management order.?

I was in a car accident, rear ended someone, no insurance, my passenger after 3 years is trying to sue for personal injury. Received a few stitches under eye. Filed 17 days before statue of limitations in California so case was filed. Seen this person after accident and they were doing fine not longer after the accident.
Anyway I was hit with a summons which seeeeems very frivilous and as if it is being sent by a "oppurtunist" who is trying to get whatever it is they can.
How do I reply back to this summons and case management order. Please be detailed. I understand if this person would be reasonable and go hey here are my medical bills etc…and here are the actual numbers. But to attempt to sue for pain and suffering, loss of wages etc… is ridiculous. I have seen this person driving, looking like life was just fine, this is very suspicious to claim any pain and suffering, if anyone went through pain and suffering it would be me I lost a vehicle, was sued by the other parties whom a paid some money…How can I bring these people back to reality…

I was in a car accident (wasn’t my fault) that left my car severely damaged but not totaled. My insurance company paid to have my car fixed and is now going after the third party insurance carrier to pay for repairs. I also filed a diminished value claim against the third party insurance carrier. The third party insurance carrier has given me a lot of excuses and tried some sneaky tactics to get me to drop the diminished value claim. Now, I am receiving a letter from them saying receipt of advance payment in reference to the payment for vehicle repairs. I don’t understand what it is but it says "this is not a release". Can someone explain the purpose of having me sign this and why I would need to sign it if that part of the claim is between my insurance carrier and the third party insurance carrier? Am I supposed to sign before or after my insurance carrier receives payment? I’ve been trying to get a hold of my insurance carrier to ask them this but they have been hard to get a hold of over the past couple of days.
I recently had an accident and got hit by a tire in the interstate, my car was severely damaged and I suffer some injuries. My insurance is dealing with it as an insured motorist claim. My question is, years ago I had a surgery on my knee, since then it got better, but I injured it again during this accident, would it be a problem claiming it for a settlement????
Ok i was just recently in a bad car accident, we was hit from behind and was thrown off the road and rolled into a pond on our top. It was my husband and I in the car. He has a Fractured Vertebrae and of course, is sore everywhere on his body. I have bruses all up and down my leg, some of them are clearing up but not the big ones and my upper back going in towards my neck HURTS still, and i also is very sore and its got to the point where i cant even take care of my son or get to sleep at night. My question is, they tryed to settle our claim with only 1400$, that just seems very wronge to me. I think we should settle with no less than 15,000-20,000$ but i still dont know, my husbands neck may never heal!!
Today I hit a car in front of me at like 5km/h, it was a very slow impact and it was snowing like crazy so the roads were slippery and my car slid slowly as i tried to break. There was absolutely no damage, not even a scratch to either of the cars.
It was a 50yr old black lady. She was fine, but claims that she hit her head and may get a small bump. We pulled to a gas station that was nearby and exchanged info on the drivers license + phone numbers. She did NOT ask for insurance policy papers, so we did not exchange those. She said that she will not report this as there was no damage. No police report, we just drove off.
Should I report this to the police/insurance company? I’m worried that she might report it and claim some bullshit damage/injury money and since i dont plan on reporting it I would be fucked.
Also, what if 6 months later, she get some injury unrelated to a car accident, and then decides to claim that it was me who hit her since she has my info and sue me or some crap? Whats the worst thing she can do?
Another thing, I was driving my parents car, I’m under the insurance, but what if this this thing that i described above comes up, can they get in trouble?

In Dewc 2008 we were rear ended. I received c-spine injuries and had to have disc replacement and fusion as a result. Our family coverage paid for these expenses. We tried to work with the insurance company ourselves but they would not pay anything. So March 2010 we hired an attorney. My question is… what is the average time to settle one of these cases? I realize it depends on a lot of different factors… but… I am wondering if anyone has a clue as to average time? It is with American Family Insurance if that makes a difference. Thanks!
