do you think it would lead to less abuse of process?
What about limits on the fees that could be claimed in personal injury cases by the ambulance chasing scavengers of the legal profession? Suppose the maximum were to be set at three times the national minimum wage for time demonstrably spent on a case, plus expenses limited to standard class rail and tube fares where necessary, and overnight accommodation in a two star hotel? Wouldn’t this be reasonable remuneration and disbursements?
Can you think of other legal work where fees and expenses ought to be similarly limited?
On friday I was hit from behind by another car. I was stationary, with my handbreak on. The car did not attempt to stop and ploud into me at around 40-50 mph. As a result of this every car following this car also crashed into the back her ( like a dominoe effect) this, then shunted me around 5-6 times into the cars in front of myself. I was sandwiched between these cars in my little mk4 fiesta, untill i cut from the car and taken away on a spinal board and away in an ambulance.
I was released that evening with no breaks, but since then I am unable to grip anything tightly with my right hand, I can not lift my arm completely. My chest is bruised and so i cannot sit up from a lying positiion by myself. My neck is sore ( common whiplash) and lower back.I also have a perforated ear drum which has made me deaf in my left ear.
It wasent untill today that I have spoken to my solicitor about personal injurie claims, so no nothing about them. I actually feel quite unlawfull claiming for money for my pain…sounds silly but its not something i know much about and what i do know, people usually lie or exxaggirate their injuries….
obviously my car cannot be replaced, and i cannot at this point in time afford to buy a new one. I am off work obviously due to this, and am unable to really go anywhere by myself.
how much do you reckon i would be liable for, or how much should i settle at as some people have told me to not take the first quote they give me.
yes i have received medical attention. saw doctor on monday, whoo diagnosed whiplash etc and put me on pain killers and anti biotics for ear. going back friday as its staill painful. i have been told to expect to wait 2-3 months before i hear from a concultant regarding the claim to asess me at a further date, which is understandable…
no, there was 2 cars in front of me, the one at the very front jammed on HER breaks. the car behind her stopped, and myself, as there was enough distance to. also we didnt have to skid or anything. she stopped for no apparent reason. as the crash wasent caused untill the girl behind ploud into me, its her thats being ‘blamed’ .
also before this happpend i looked in my rear view mirror and saw her coming towards me talking to her passinger. she made no attempt to break. also the first thing she did was run to my window screaming ‘im sorry im soo sorry its my fault im sorry!!!’
i already have a lawyer on the case. just wandered how much i would be to expect…
While shopping at sainsburys, I had a cut to the palm of my hand. While trying to get some clothes off the top rack, there was a sharp pin like object sticking out of one of the pillars in one of the aisles which i accidently hit my hand across. It removed quiet a fair bit of skin and i could see a small hole in my hand. Blood started coming out and i tried to keep pressure on it but no use.
I contacted the first aiders at sainsburys reception who tried to stop the bleeding but could not for 15 minutes. The palm of my hand kept filling with blood everytime they wiped it clean.
They then called the ambulance as they failed to stop the bleeding. The ambulance guy, upon arriving said that why call him for such minor wound. But even after 45 minutes, he was still not able to stop the blood coming out. He asked me to go to hospital with him but i did not want to waste time there so stood my ground. Eventually the blood stopped and he put a bandage on it.
He told me to go hospital the next day. I had such a bad pain in my arm all day. Next day i went to hospital and had the bandage replaced. I had to keep it on for another 2 days. Thank God it was my left hand otherwise i would not be able to work.
I wanted to ask, can i claim some compensation? Is it worth contacting some of these no win no fee companies?
Thanks,
Sunny
On Monday my Boyfriend who works for a tool hire company fell off a ladder roughly 11ft. Anyway he was at work on his own and knocked himself unconcious after being out for about 50 mins he came around realised he was in pain and lieing on his back managed to reach his mobile phone in his pocket and rang for an ambulance…..he is in 2 minds wether to put a claim in or how to go about it because he shouldnt have been up the ladder….. even though it was because he was closing up and the shutter had jammed and he had to fix it. are the company at fault for letting him be there on his own isnt this against Helath and Safety laws within an industrial company?
I was driving my mothers car (we’re from NJ) with her in the car with me, I don’t have an insurance policy and hers is a disabled persons insurance policy that only covers injury to the policy holder and anyone in the car of the policy holder. I have a valid drivers license and I am also disabled. I was going about 20-25 in traffic and the person in front of me stopped but I was following too close and couldn’t stop in time even after slamming on the breaks. I hit them in the back at about 20-25 or so maybe less since I was breaking when I hit the person. Anyway they get out of the car and are saying they are fine but then call the ambulance and claiming neck pains. I don’t have any money whatsoever and neither does my mother. All we have is the money we get from disability each month. The person I hit suffered some bumper and muffler damage in the back and in the front since she hit the person in front of her (close traffic situation) but the damage to the front of her car and the back of the 3rd persons car is VERY minor, scratches to the 3rd person and a small portion of bumper cracked off of the front of her car. The question is, if I have no money and no assets as well as no insurance, while the kind my mom has doesn’t cover anyone else, then what am I looking at? I don’t know what to do or what to expect. I don’t even know how i’d be able to pay a lawsuit claim if one is made. My car looks like it may be totaled. I also sustained no personal injury. I just don’t know what I am going to do or how I am going to pay a lawsuit with no job and no money. Since me and my mother are both disabled neither of us have a job. So I really am at a loss now as to what to do.
I was in a car accident back in June. Another driver ran into the back of me on the motorway and pushed me into the car in front. My car was a total write off and I lost a number of belongings.
I was taken to hospital by ambulance in a neck brace and on a spinal board to have neck and back x-rays. I was unable to return to university for 2 months and am still suffering some pain and discomfort.
My insurers are putting in two claims for me; one for financial losses and the other for personal compensation.
Now, I am happy with the claim to cover my financial losses (contents of the car that were damaged, osteopathic treatment etc) and my insurers have said that they will apply for between £1,900 and £2,300 personal injury compensation. Does this sound reasonable? Has anyone else made a similar claim?
I rear ended a car at an intersection as the car stopped for a green light. I was at fault. The police and ambulance came, but everyone declined medical services. Both me, police and fire asked the other driver multiple times if the driver was fine and the driver said he was. The driver and I both drove our cars home the scene. What are rulesa civil suit for injuries and stuff? Since the driver said he was fine than he waived his rights? I am only worried about a civil suit as insurance will cover all else.
i was in an accident in january, i was pulling out of a driveway and a car struck the passengers side, they took a police report and everything, the other car the frnt bumper came off, yesterday i got a call that i had a claim for ,000 because that person got hurt. The fault was mine. When the police report was done, she said that she was not hurt that no ambulance was needed, ow the insurance company tells me she did get hurt….how does this work or what can i do? is it legal to do a claim after 5 mnths of the accident?
how come is she doing her claim that she got hurt if she had already said that she was okay???
