I was involved in a minor accident last week. It was my fault. I bumped into the back of the car in front, going about 15 miles an hour in rush hour traffic when she slammed her breaks on to let a car who was going in the opposite direction turn right in front of her. So, the damage to my car is to the bumper – it’s hanging off and needs replacing. The thing is, my car is not worth much. It’s an old M reg Astra and I’ve been advised by a friend who knows a lot about cars that it will probably be written off when it goes to the insurance companies garage as the cost to repair will outweigh the value of the vehicle. That said, my excess is £300 and I had a quote from another garage for £120 for replacing the bumper on my car (this was before I got a phone call from the other driver involved that told me she was no longer willing to let me pay for the damage to her car outright because she was "injured" and was claiming personal injury) and my insurance co. told me if I didn’t put my car through the insurance they would still have to send an engineer out to assess the damage and I couldn’t get it fixed until that had happened and it would take me twice as long and maybe cost me more to do it that way so I may as well put my car through the insurance. If they do write it off, can I refuse or contest this? If not, and I buy it back, will I have trouble getting a "written off" car insured, or how much do you reckon my premium will jump up because of it?

In addition – nice two points there for totally not answering the question. I am fully aware that the accident was my fault, and I am also very aware that it is good manners to allow a driver to turn right in front. It wasn’t, however, good manners for the driver that was turning right to exceed the speed limit to drive down the inside of almost stationery traffic in order to turn right, and it is also not good manners to do an emergency stop in rush hour traffic. HOWEVER, I still acknowledge that the damage to mine and the vehicle in front was MY fault – as I said originally. The above details were irrelevant given that my question was not insomuch a question about my claim, or how much of a reckless driver you deem me, but a question about my car should it be written off. Keep your smug attitude to yourself, and if you’re that much of an a-hole that you can’t manage that, at least try to answer the question or just don’t bother replying.
I am not a "young" driver, but I am a relatively new driver. I do not make a habit of driving up the a**e of other drivers. I obviously did not adhere to the two second rule, or my reactions weren’t quick enough. I was pre-occupied, wrongly, with the need to get home quickly due to a family emergency – none of which I think is an excuse, though seeing as you all came here to judge me rather than help with a genuine concern I thought I’d give, yet again, some more irrelevant information to you. How many more times do I have to acknowledge that it was my fault before somebody will just help me with my question?

My car insurance company had increase my insurance by 2 folds (103%) increase. I contacted the company, enquired about this increase. But they said they cant do anything about it, If I want I can raise this with the customer service chief and chief executive. I wrote them a letter stating it was ridiculous amount of money, they asking me to pay. Also clearly brought to their notice, that I have a clean history, no claim, paid insurance on time, no accidents, and I have no claim discount of 7 years in total.
The companies chief executive has replied me in a letter stating, unfortunately, the post code where is stay is subjected to recent increase and personal injury claims from post code area has gone up. So nothing he could do. But I replied him saying, I lived in the same place for more than 5 years. But still no good.
Regards to this, I email Watch Dog, explaining the same a month ago. Still no reply or correspondence from them.
Now I am stuck, I do not what to do. Honestly, I only brought this care for £500 in very good condition and it is still the same. But my insurance is more twice the value of my car.
Please somebody tell , what can I do next. This is really ridiculous amount and unacceptable whatsoever.

Unfortunately, all the other insurance companies also gave me similar quote. So am really stuck here, should keep the car or sell it.

We got into a car accident about 2 and a half weeks ago. We were making a right hand turn with NO stop sign. After the right hand turn we were headed east. Someone who was also east bound but had a stop sign ran the sign and broad sided us. Granted he slowed down considerably and the damage didn’t look to bad but it was our 1st accident so we filed no police report and told the guy that we would let him handle it and take to it his friends body shop and he would pay for it. Later on our family members tell us since it is an old car (96 saturn) it would more than likely be totaled so we needed to file a claim with the insurance so we did. Now he is not complying with his insurance by not answering the phone or answering to letters. So they are going to drop the claim and we would have to take him to small claims ourselves. As far as i know we, as inidivuals are not supposed to be taking anyone to court it should be handled between the two insurance companies. Is this right?

I recently got into a car crash, in which i pulled across the opposite lane in which to park in a space. Out of nowhere a car came belting my way and so i tried to turn to miss it but she hit my car (it is a write off) and she also hit 2 stationary vehincles. She is saying she wasnt speeding but she was. There ar no independant witnesses to this accident. I was taken into hospital with a suspected broken wrist and concussion which i am told will last about a week so i will be off work for at least 2 weeks. I passed the breathalizer no problem whereas she barely passed it. I only get paid for the hours i work so i have lost alot of money from being off.
The police have informed me that as there are no independant witnesses then it will be the insurance companies job to battle it out. The police made me feel as if it was all my fault, whereas I know for sure that she was not there before I began to pull in. I had a massive knock to the head so i dont remember anything after that. But she refused any hospital care. Or any treatment.
What will the insurance companies make of this?
If they do decide that I am the one to blame, then where do I stand with personal Claims?
I am fully comp and and have 5 years no claims.
Any advice would be great.

Lets say both insurance companies deny other driver’s claims so both parties sue the insurance companies.
Can it be possible for both sides to win since it will be two seperate trials?

I got in an accident a month ago. I was going north towards the intersection of the parking lot. The other driver was coming into the parking lot from the west direction traveling east. I clearly saw the driver and stopped b4 the intersection allowing the other driver to go ahead. Instead of going straight (east) he slowly made a wide right turn towards me running into the front left side of my car. He claims he didn’t see me but it looked as if he was looking right at me. Anyhow, he apologized from the time he hit me until the police report was written up. He knew it was his fault. It happened on private property so no one was issued a ticket or placed at fault. Police informed us that we would have to file a claim through our insurance companies to determine fault. I asked the guy to just call his insurance and admit fault to expedite the process faster and he agreed. Of course when I call to give my statement his insurance company (Allstate) says that we have conflicting stories. Motherf%#*er! I have this huge dent on the front side of my car while this guy has a barely noticeable scratch on his bumper. I called the guy and he said he did admit fault so I don’t know who is lying him or the insurance company. Since we had conflicting stories Allstate said that they were waiting for the state police report to be sent to them to determine liability. When they did receive it they said it was blank. Also they told me I couldn’t contact the guy about it anymore. They told me to contact my insurance and have them pay for the 00 worth of damages. Whenever the topic of fixing my damages arise they mention having my insurance pay for 100% or if it can be agreed on each company paying 50%. There’s something shady about this whole situation. It seems as if Allstate doesn’t wanna pay up. Has this every happened to anyone? What should I do? Based on my description and damages, isn’t it clear who is at fault?
What if I find a witness to the car accident a month after I filed the claim?

I was in a car accident with two other vehicles. Vehicle No. 1 hit vehicle no. 2, who hit me vehicle no. 3. Both Vehicle 1 & 2 insurance companies have inspected my vehicle and made the determination of my vehicle being a total loss. They have both offered me a reimbursement amount for the loss of my vehicle. Can I accept a check from both companies?

week ago, on my first one i hired a attorney and filed claim and got paid…It was my neck and same thing this time. I wonder would the insurance companies deny the claim with the attorney by saying that this injury from a week ago is from previous car accident?

I had my car backed into in August.
The man was cited for improper backing.
He did have insurance.
I have been battling with them since August to get paid,,there was a considerable amount of damage to my car as he was going fast and kept going in a panic.
The Co. (Allstate) has said they have to "contact" him to confirm fault,,in Ct where I am there is No fault..but they keep playing this tune…there was a ticket as I pointed out to the Co..this is clear of who’s fault it is…my car was parked and was not moving.
Can I sue the Insurance co. for double if they continue to refuse to pay me? Or is this just for personal injury?
Can I ask for loss of vehicle use only if I use a rental?
Is there anyone (ha ha) I can file a complaint with regarding the lack of cooperation with them,,I know FTC handles businesses but are insurance companies above all?
My car was damaged and I would like to be compensated..my own insurance is at the lowest so they do not cover me,,won’t even help me.
How can they take so long?
I am so frustrated.

This woman came into my lane and hit me (didn’t check her blind spot). After hitting me she sped off. I caught up to her and she immediately started apologizing. But once the police got there she said we "bumped." I continued to stick to my story but she’s changed hers several times. Long story short our insurance companies found no one at fault and now I have to pay to get my car fixed. She barely had any damage but my front driver’s side was totally screwed up.
Since there aren’t any witnesses all I have is my word again hers and a taped conversation we had. I thought about taking her to small claims court because I know she’ll lie and her story doesn’t even make sense. Could I use the recording in court? The recording law says that as long as one party knows it’s being recorded it’s valid. And even without the recording could I win against her since her story is so sketchy and ignorant? I just want 0 to fix my door (it doesn’t even open).
Also what proof could I take to small claims court? Would the insurance companies release statements to me where she said what happened (I’m sure by the time we go to court she’ll have a new lie).
The police didn’t file a report, just a "record of collision" and I already have a copy of that.
