I was served a summons and a letter of case management order.?
I will be very clear….
I was in a car accident, rear ended someone, no insurance, my passenger after 3 years is trying to sue for personal injury. Received a few stitches under eye. Filed 17 days before statue of limitations in California so case was filed. Seen this person after accident and they were doing fine not longer after the accident.

Anyway I was hit with a summons which seeeeems very frivilous and as if it is being sent by a "oppurtunist" who is trying to get whatever it is they can.

How do I reply back to this summons and case management order. Please be detailed. I understand if this person would be reasonable and go hey here are my medical bills etc…and here are the actual numbers. But to attempt to sue for pain and suffering, loss of wages etc… is ridiculous. I have seen this person driving, looking like life was just fine, this is very suspicious to claim any pain and suffering, if anyone went through pain and suffering it would be me I lost a vehicle, was sued by the other parties whom a paid some money…How can I bring these people back to reality…

I was rear ended and my car was totaled. The other driver took full fault.

The other driver’s insurance is very very limited and I know it will not cover medical, rental expenses, pain and suffering, and time off work.
(I was told that small claims would be my best option)

The accident was only two days ago.

…at the scene my husband tried to get the insurance info from the other driver but the officer stopped him and said it would be on the report. A week and a half later we are still waiting for the police report so we can file a insurance claim on the other drivers insurance. We gave up going that route and decided to file a claim through our insurance so we can get the insurance adjuster too look at the car to decided if it is totaled. My question is since we went through our own car insurance even though the other driver was as fault can we sue him for personal injury and pain and suffering?? How does this work?? Will our car insurance do it for us and give us a check or how??

Ok I fell down a flight of molded/mildewed stairs last august. I was on the clock for work, but I was at a customers house. It was a workers comp case. My back is perminantly screwed up. The dr has released me saying there is nothing more they can do untill my lower back discs explode basically. He gave me 6 pills I have to take to just ease the pain. Muscle relaxers, pain meds, anti inflammatorys, etc…the wc claim was settled simply for back wages and medical up to this point.. my attorney thinks I need to file a personal injury case against the home owners ins since wc can’t pay pain and suffering and future pay lost. I feel bad though. But on the other hand there are days I can hardly walk without crying. I’m only 23, 22 when it happened. What should I do?

Mt attorney keeps telling me not to feel bad and that’s why people have insurance.

was recently in a major car wreck riding passenger on i-240 eastbound, traffic was at a complete stop due to merging traffic on 35 southbound…. we come to a complete stop and get rearended about 3 mins later, by a drunk driver at 75mph also causing us to hit the people infront of us. causing the truck to look like the letter ‘V’ THE TRUCK IS NOT MINE. but is for sure TOTALED! i have severe neck and back problems they said i have whiplash and have been givin hydrocodone and flexeril for the muscle spasm’s in my neck, the impact was so hard it knocked the hat off my head glasses off my face right shoe off of my foot as it was slung outside the passenger door, and the truck dash crumbled into peices no joke!!!! my door swung open as the truck spun a 180 facing oncoming traffic, with my right leg dangling out. at that point i was in severe pain not being able to move my neck at all and my head and the back of my neck hit the window frame of the the back glass on the 97 gmc ex-cab i have glass stuck into my head along with plenty of good scratches and still have remaing glass in my head/neck and major swelling on the lower part of my head along with my neck, i am on probation as well and am not able to seek active employment as requested due to this wreck, also this is a little personal but i feel its for sure "PAIN AND SUFFERING" 1. I have trouble pooping it hurts my stomach badly and my lower back. also when i cough its like i got hit in the stomach with a baseball bat….. 2. since i am on muscle relaxers due to the major pain and strain of the neck aka whiplash, i cannot enjoy any sexual activites with my girlfriend.

how much $ am i entitled to? i feel that money isnt the issue at this point, the issue is if/when will/can i be better, but i need a round figure to request on the personal enjury claim… please share your info…. thank you! and be carefull!!!!!!

Pain and Suffering question for UIM Claim?

I was in an auto accident that was caused by a car crossing over the median. The car did not stop and I slammed my car into a tree. I broke my right heel, and since I had 2 witnesses (who stopped and helped me) my ins. co said they would settle my claim under my UIM coverage. My limit is 50K and to date my medical bills are around 8K. I’m wondering if pain and suffering is included in UIM personal injury coverage and what is a reasonable amount to ask for? A little more info:
My OS told me I’m going to have arthritis and joint stiffness in my rt foot for the rest of my life and that I’m losing much of the r to l motion in that joint so it will be difficult for me to stand on uneven ground.
Currently undergoing PT 2x a week – still not able to bear full weight.
I was pretty active before this, and I’m a 30yo single mom to an active 3 year old. I haven’t been able to drive, do daily activities, etc. for the past 3 months.
I was unemployed @ time of accident, so I won’t be asking for lost wages.
I expect to fully recover and be able to walk without a limp since it was a "clean" break per my Dr.
Ive been told to wait, but seeing as my limit is 50K, I was going to ask for future medical costs, esp associated with arthritis, and joint stiffness. Is arthritis considered a permanent injury? Also, being unemployed with mounting medical bills, time is of the essence. I will appreciate any responses!
Well, my part time job, which is a family owned business, requires alot of physical activity. I’m really looking for a starting point of what amount to ask for as Ive read that asking for too much up front can make your settlement seem frivolous.

In insurance claims involving personal injury, an amount is usually added for the victim’s pain and suffering. How is this calculated? "Pain and suffering" is not an objective measure – everyone perceives pain in a different way. What hurts one person may not hurt another so much. So how do they know how much to pay?
