I was in a traffic accident four months. In the incident, I went into the side of a van and came off my motorcycle. The driver had stopped abruptly, indicated and turned into a side road without looking in his mirrors. Causing the accident, the driver failed to stop. Luckily, another motorcyclist who saw me come off my bike, gave chase and caught him and asked him to come back to the scene.On his return to scene, he failed to accept liability on the spot and thus insurance was involved to cover the costs of my damaged bike.
A few weeks ago, my insurance company notified me that they were going to try to settle the case for a small amount of money. This was after the police report stating that they were asking the van driver to attend a road safety course and would prosecute if he failed to do so. I then received a letter yesterday stating that my insurance company were now going to start court proceedings and asked me what dates I couldn’t attend.
After all this, I’m now worried about the case as personally, I’d rather not go to court. What are the chances that this case could go all the way to court? My claim is for only £1300 (as personal injury), will they go to all the hassle of going to court for such a small fee? s it just a tactic? What are my chances for the case in terms of all the information that I’ve given?

We got into a car accident about 2 and a half weeks ago. We were making a right hand turn with NO stop sign. After the right hand turn we were headed east. Someone who was also east bound but had a stop sign ran the sign and broad sided us. Granted he slowed down considerably and the damage didn’t look to bad but it was our 1st accident so we filed no police report and told the guy that we would let him handle it and take to it his friends body shop and he would pay for it. Later on our family members tell us since it is an old car (96 saturn) it would more than likely be totaled so we needed to file a claim with the insurance so we did. Now he is not complying with his insurance by not answering the phone or answering to letters. So they are going to drop the claim and we would have to take him to small claims ourselves. As far as i know we, as inidivuals are not supposed to be taking anyone to court it should be handled between the two insurance companies. Is this right?

I was in a car accident recently, just coming out of a parking lot, some guy jumps out infront of the car ahead of me – the car stops instantly causing me to bump him from behind.
There was no damage on my car, with his however, he claims that his car has been crumpled internaly and that the boot seized to open properly.
We were travelling around 5ks /hr. nothing much, just coming out of a parking lot, it was basically a tap.. he got a quote to fix it for around acouple of thousand! (4+)
I know the guys acting shifty. Hes car is worth nomore than 5(max)
Btw, It wasnt MY car at the time, but i was on as thirdparty. called the insurance company today, and they said that it has been lapsed due to some payment issues. *??* hence inactive at the time.
The guy that I hit is insured 3rd party.
I can only afford around 1000, nothing more. (uni student)
Would he be able to file a police report? What would i be able to do in this matter?

Hmm.. i guess im worried about if he can sue me. Would he be able to press charges or something?
Is there an agency that deals with these kinds of issues? I just dont want to wake up one morning with a 00 bill under my door. Although a month sounds good =)

I believe it was my fault and there was a police report.
I’m only a minor so we settled to pay the minor damages in cash at the body shop. Now, will the insurance still know about this or is there a way to avoid this by going to the police station? Both parties will NOT file insurance claims.

Alright….
–I’m in my car driving and I have a friend with me. I’m waiting at a red light and out of nowhere comes a car that rear ends me. I go outside to talk to the driver, but he runs away ON FOOT. Anyways, I call the cops etc. they write a police report of the accident and my friend complains of "back pain" so I take him to the ER (just like he stated) and he turns out to be fine just that his muscles were pulled.
Anyways, my insurance company (state farm) is covering all of the medical expenses, they give the passenger ,500 to use on medical related issues. My friend goes to the Chiropractor to get more "treatment done" and the bill will exceed ,500 that my insurance company has stated to provide him (they told him before he went to the Chiropractor btw).
Anyways, now he’s complaining that he needs more money, and that he’s going to fight with my insurance company. On the other hand, the guy who is responsible for the entire accident has a crappy insurance policy, not to mention he claims that his car was "stolen", when he never filed a police report prior to the accident stating that his car was stolen(my main suspicion is that he was drunk at the time of the accident, that’s why he ran on foot). Anyways, my insurance company told me friend that he has to either pay through his health-care, or he has to fight with the other guys insurance company if he wants his medical bills paid. My main concern is, am I liable to pay his medical bills even though I wasn’t at fault for the accident? Or would he have to sue either my insurance company or the other guy’s insurance company for his medical bills to be paid off?
REPLY: I live in Texas, so does strict liability still count towards me?
So you guys are all agreeing that it’s NOT my liability to pay for his medical bills (if my insurance company doesn’t) ? Because the accident itself wasn’t my fault, and my insurance company provided everything they could. I AM FULLY INSURED BTW.

If I have an identity card and the person who knock your car door and wheel side impact during the accident but gave me his a car number plate and a car model ask me to claim from his car insurance after the car accident and promise to meet me at puchong police station for insurance settlement issues, but never turned up? Do you think he has and insurance? Why did he not turn up if he says he will settle using his car insurance and i let him go because he said he has few ringgits to use only but how can he drive on the road if he just has few ringgits, in case of emergency during driving. I will not drive if i have a few ringgits in my pocket, anytime during car accident cannot pay clinic bills.
Now m’sian police will have to investigate is he a malaysian and is he driving a stolen car or a car that cannot be declared after accident for whatever reasons whether he has a driving license or not because he never turn up in the police station for insurance. He was driving WES4329 Red satria knocked me at IOI mall car park WJB5905 on the left side of the back wheel and head on using his car front bumper to the side of my car due to his carelessless, looking at the woman sitting beside him, not concentrating that there is a car stopped right in front of him which is me using WJB5905. Malay Police says they will follow up whether he will come to the police station and deliver his religious promise. 2 months waiting period for insurance claims. Since i am working night shift, i told the car workshop to temporarily inform me once insurance claim has been done in the right way because the PIAM car workshop in puchong (HUP Hoong Motor Works, in perindustrian Kinrara, saw and believed that it was indeed a bumper impact on my car door and I was innocent) from a foreman forensic view on my back wheel condition and the impact on my car door. He said he will follow up with the insurance and follow up on the police report in 2 months time). The risk i will take is whether he is a malay or indonesian/foreigner driving because their skin colour looks the same and whether he has an insurance or no insurance.

I was just being good hearted and i let him go because he pleas the he has only a few ringgits in his pocket and he claims his relative is a policeman, and ask me to trust his faith in God. To investigate with car number plate will probably involve payment for police to start investigation on car number plate, hopefully it is not above the price of my insurance, just on the car number plate and car offender’s insurance company
If the price of tracing the insurance offender cost more than the insurance claim, then i think my comprehensive car insurance does not protect me as a citizen

so my daughters name is not with the insurance company. she got in a car accident but we didnt file a police report. but now i wanna call the insurance company so they can fix the other persons car. can i file a claim with the insurance company if her name is not with insurance? i live in new jersey

My friend got into a recent car accident on the freeway in L.A. A car cut her off on the highway and forced her to hit a big rig. The car left the scene and the only thing was recorded (Car and Make/Model of Vehicle). Also, another car was forced into an accident from the hit and run driver. Hitting the big rig too.
A police report has been filed. However, there were some passengers in my friend’s car who are also hurt.
If my policy is purchased one way and no medical payments coverage, is it enough proof and evidence to convince the insurance carrier to open up a Uninsured Motorists Bodily Injury and Property Damage claim?
Also, the car is seriously damaged. Should I even take the car out from the tow yard?

When someone has a single car accident and there is no other vehicle or person’s property that is damaged, how does a claim proceed, if the owner decides to file a claim?
Say a car avoided a deer or object in the road and ends up in a ditch or blows a tire and hits a tree or such and the vehicle is still able to operate. Is a police report mandatory? Does the location have to be exact if this occured in a VERY rural location? What steps would an insurance co. take after being notified?

There is NO ONE ELSE involved! The question being asked is for an accident that occured alone, in the middle of nowhere with no personal property or persons involved!.
There has NOT been police report done because police will not come out to some unpaved forest road for a fender bender(although prob. expensive), but still, not a serious accident. Do insurance co’s REQUIRE police reports?
I KNOW police will not respond because there were no injuries, fatalities, or second/third parties involved.
Besides, what if I didn’t have a method to communicate with authorities and report the incident?

I was in a car accident back in March. The other party that hit me was at fault. A police officer WITNESSED the accident and he wrote the police report. He stated the other party was driving at an unsafe speed for the driving conditions. What are my rights as far as claim settlement amount (for example 2-3xs medical bills settlement), timeframe of settlement, etc.
